In this privacy policy, "us", "we" or "our" means My Property Partner, mypropertypartner.com.au (ABN 482122 65189). At My Property Partner, we are committed to ensuring the privacy of your information. We understand that as a customer, user or member using the My Property Partner website how important the privacy of your personal information is to you. The following statement addresses relevant privacy issues for My Property Partner. However, if you have any further questions relating to this privacy statement, please do not hesitate to email us.
PRIVACY STATEMENT
In completing the application and registration process, you have been asked to provide information in connection with an application you have made to become a My Property Partner user or member.
My Property Partner may want to verify your information and responses and may utilise the services of a credit reporting agency to assist with public record consumer credit services and identification checks for the purposes of assessing your application for registration, membership and or use of our services. For each assessment performed, a credit reporting agency database is searched and returns any public record adverse information recorded there against the individual (e.g. bankruptcy, judgments, summons etc) at that point in time. This information is sourced from the relevant bodies (e.g. ITSA, courts etc). It does not return default information against an individual from other credit providers (access to default information is restricted to Credit Providers only by Part III of the Privacy Act).
The personal information you provide and any other personal information collected during the registration and membership assessment process will be used by My Property Partner in the course of considering your application for registration and membership.
My Property Partner has engaged external contractors to conduct public record credit and identity checks and to verify some or all of the information you have provided for these purposes. The credit reporting agency may use the information and responses you have provided to apply to government agencies and other relevant sources for verification of your information and responses and to conduct public record searches. Credit reporting agencies are under an obligation to keep your information confidential and not to use it for any other purpose.
You authorise My Property Partner to use the information and responses you have provided for these purposes, and for the credit reporting agency to report this information to My Property Partner for the assessment of registration and membership services. Depending on information you supply in the registration and membership assessment process, the credit reporting agency may conduct credit and identity checks regarding your residency, claims, judgments, current and previous directorships, and other public records. The existence of a prior claim or judgment or other information relating to the registration process and application for membership will only be taken into account by My Property Partner where relevant and will not necessarily make you ineligible for registration or membership. Although we may request information regarding your age, gender, and names, this information will not be a factor in any decision regarding membership and registration. It will only be used for the purpose of the credit reporting agency requesting information from government agencies or other sources which require this information in order to process requests for information in the application and registration process. If you do not provide the personal information requested in the application and registration process and its necessary consents, My Property Partner may not be able to offer you registration or membership.
When you use our site, read or download information, we may collect details on your visit. This may include:

The date and time of your visit
Whether you have visited us previously.
The information we collect generally relates to your server or PC rather than yourself (except where personal information is provided to My Property Partner in accordance with our Privacy Policy).

INFORMATION WE COLLECT
We collect personal information from a variety of sources, including from you, members of the public, advertisers, prospective employees, mailing lists, recruitment agencies, credit checking agencies, background checking agencies, contractors and business partners. In general, the personal information we collect includes (but is not limited to) name, email address, phone number, residential street address, drivers license number and other contact details and possibly financial information, including credit card information. We store the personal information you enter on My Property Partner or give to My Property Partner in other ways. We obtain most personal information through the My Property Partner membership registration and credit checking process and updates to membership details. You may also provide information to us when you request or acquire a product or service from us or our related companies, provide a product or service to us, complete a survey or questionnaire, enter a competition, participate in forums or when you communicate with us by e-mail, telephone or in writing. We obtain personal information that you provide as part of your My Property Partner member profile, such as age, gender, profession, interests, education, and location. We also obtain personal information that you otherwise post or transmit on My Property Partner, and personal information provided to us via My Property Partner or otherwise by any other person.
For each visitor to our web site, our web server collects the following type of information for statistical purposes:
- The number of users who visit the website
- The date and time of visits
- The number of pages viewed
- Traffic patterns. This is anonymous statistical data and no attempt will be made to identify users or their browsing activities. We use this data to evaluate our website performance and to improve the content we display to you.
HOW WE USE THE INFORMATION WE COLLECT
We may use information we collect from you for the primary purpose for which it is collected and for such other secondary purposes that are related to the primary purpose of collection. We generally use personal information to:
- provide you with products or services you have requested (including to post your member profile on My Property Partner and transmit your messages to other members);
- personalise and customise your experiences on My Property Partner;
- help us manage and enhance My Property Partner;
- communicate with you (including transmitting messages from other members);
- provide you with ongoing information about opportunities relating to My property Partner that we believe you may be interested in;
- give you the opportunity from time to time to receive e-mail and 'e-newsletters' from us;
- investigate any complaints about or made by you; and/or
- investigate you or you’re My Property Partner account if we have reason to suspect that you are or have been using My Property Partner in breach of the terms and conditions of use of My Property Partner or if we have reason to suspect that you are or have been otherwise engaged in any unlawful activity.
In most cases where we ask you to provide information about yourself, if you do not provide us with that information, we will not be able to complete the requested process or provide you with the requested feature, product or service.
You agree that personal information that you provide and/or we obtain as part of you’re My Property Partner user or member profile, or that you otherwise post or transmit on any public area of My Property Partner, is non-confidential. You agree that we will be entitled to use such personal information for any purpose.
We may disclose personal information to other organisations that may only use it as set out above. My Property Partner may also provide your information to third parties:
- engaged by My Property Partner to perform functions on its behalf, such as processing credit card information, mailouts, debt collection, marketing, research and advertising;
- authorised by you to receive information held by us (including other members);
- as required or authorised by or under any law;
- as a necessary part of any investigation by us into you or you’re My Property Partner account (including to your Internet Service Provider or network administrator); and/or
- if we have reason to suspect that you are or have been using My Property Partner in breach of the terms and conditions of use of My Property Partner or if we have reason to suspect that you are or have been otherwise engaged in any unlawful activity and we reasonably believe that disclosure is necessary, for example, for the prevention, detection, investigation, prosecution or punishment of any unlawful activity (including to the Police or any other enforcement body, or your Internet Service Provider or network administrator).
You agree that personal information that you provide and/or we obtain as part of your My Property Partner member profile, or that you otherwise post or transmit on any public area of My Property Partner, is non-confidential. You agree that we may disclose such personal information to any third party for any purpose.
You agree that we will be entitled to track your activity on My Property Partner, including by making a record of the member profiles that you view, and display such usage information to other members (provided that, in that case, we only ever disclose personal information that you provide and/or we obtain as part of your My Property Partner member profile, or that you otherwise post or transmit on any public area of My Property Partner).
HOW WE TREAT SENSITIVE INFORMATION
"Sensitive Information" means information relating to a person's racial or ethnic origin, membership of political bodies, religion, membership of a trade union or professional or trade association, sexual preferences, credit history, criminal record and health.
We may use and disclose Sensitive Information only for the purpose for which it was provided or a directly related secondary purpose or as allowed by law unless you have agreed otherwise.
WHEN YOU PROVIDE INFORMATION
The type of information that we collect from you will depend on what processes, features, products and services you use on the website. When you provide us with personal details i.e. when applying for a My Property Partner feature such as user or member registration or a product and service, we will request personal information such as your name and address, your e-mail address and a contact phone number. This information is important so we may contact you when necessary on issues relating directly to the product or service.
Your information may be used by My Property Partner to enable us to offer you other products and services that will enhance our relationship with you. It is your decision whether you wish us to provide this service to you. We may release information about you where there is a duty to the public to disclose that information. However, we will not sell or disclose your information to any individual or entity outside My Property Partner, for marketing purposes.
EMAIL ADDRESSES
We may use your email address to send our regular communications which provide information, updates on new services and special offers. It is our policy to only email customers who give us permission to do so. If we send you an email for a commercial purpose, we will give you the option of not receiving further communications of this nature.
SECURITY OF CAPTURED DATA
When capturing customer data it is passed through a secure My Property Partner server using encryption technology to ensure that your information is protected when being sent over the Internet. This also applies to information that may be collected for My Property Partner by an agency i.e. when entering a competition, where it will also be passed through a secure server. Additionally, all stored customer information is protected from unauthorised access through the use of secure passwords and user log ons or other security procedures.
MANAGEMENT AND SECURITY OF YOUR INFORMATION
My Property Partner oversees the management of personal information in accordance with this policy and the Commonwealth Privacy Act.
We protect the personal information we hold from misuse, loss, unauthorised access, modification or disclosure by various means including firewalls, pass word access, secure servers and encryption of credit card transactions.
UPDATING YOUR INFORMATION
We endeavor to ensure that the personal information we hold is accurate, complete and up-to-date. Members of My Property Partner can update their membership information via the website (through the Account Details page). Where personal information is no longer required by us, it will be destroyed or de-identified.
